Terms of Service for NavKids Africa

Welcome to NavKids Africa. These Terms of Service ("Terms") govern your access to and use of the NavKids Africa website, mobile applications, transport dashboards, and related school transportation tracking services (collectively, the "Service"). The Service is owned and operated by NavKids Africa ("we," "us," or "our"), headquartered in Nairobi, Kenya.
By registering for, accessing, or using any part of the Service—whether as a school administrator, parent, legal guardian, driver, or transport staff member—you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Description of Services
NavKids Africa provides a technology-enabled platform designed to enhance school transportation safety, accountability, and communication. The Service includes, but is not limited to:
    • Real-Time Bus Tracking: Live GPS monitoring, route progress visibility, and estimated arrival times (ETAs).
    • Smart Parent Alerts: Instant push, SMS, or digital notifications regarding student pickups, drop-offs, and unexpected transit delays.
    • Secure Student Check-In: Digital verification and QR code registration systems for accurate attendance and student manifest tracking.
    • Dashboards & Analytics: Centralized management systems for schools to oversee fleet operations, driver logs, and routing efficiency.

2. Account Registration and Security
To utilize the Service, users must create a verified account.
    • Schools & Institutions: Educational institutions onboarding the platform must provide accurate, verified administrative data, driver background verifications, vehicle compliance records, and authorized student enrollment lists.
    • Parents & Guardians: Parents must register using verified credentials linked to their child’s school roster.
    • Account Security: You are entirely responsible for maintaining the confidentiality of your account login credentials (passwords, PINs, or digital tokens). You agree to notify NavKids Africa immediately of any unauthorized use of your account.

3. Data Privacy and Child Safety
Child safety and data security are the foundational pillars of NavKids Africa.
    • Data Collection: We collect and process location data, student names, school affiliations, and check-in stamps solely for the purpose of executing the tracking and safety features of the Service.
    • Compliance: Our data practices strictly adhere to the Data Protection Act of Kenya and international child safeguarding principles.
    • Consent: Schools onboarding the system warrant that they have obtained the necessary lawful consent from parents or legal guardians to share student data with our platform for transit safety monitoring.

4. Acceptable and Lawful Use
You agree to use the Service strictly for its intended purpose of managing and monitoring legitimate school transit. You are strictly prohibited from:
    • Using the tracking data or platform information to harass, stalk, or compromise the safety of any child, driver, or community member.
    • Attempting to reverse-engineer, disrupt, compromise, or bypass the security infrastructure of the NavKids Africa applications or servers.
    • Providing fraudulent vehicle, driver, or identification data during the onboarding process.

5. Service Disclaimers and Limitations of Liability
While NavKids Africa is committed to providing highly reliable uptime and state-of-the-art safety tracking tools, the following limitations apply:
    • Technical Dependencies: The real-time tracking feature relies inherently on third-party infrastructure, including global positioning systems (GPS), cellular telecommunications networks, mobile data availability, and internet service provider networks. NavKids Africa cannot guarantee uninterrupted, real-time precision or 100% notification delivery speed where local network outages, hardware malfunctions, or satellite signal degradation occur.
    • Operational Responsibility: NavKids Africa provides an administrative and communication tracking tool. The physical safety of the students, defensive driving standards, vehicle mechanical roadworthiness, and adherence to traffic laws remain entirely the legal responsibility of the onboarding school, contracted transport provider, and individual vehicle operators.
    • Limitation of Liability: To the maximum extent permitted under applicable law, NavKids Africa, its founders, directors, and employees shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform.

6. Intellectual Property

All content, features, functionalities, proprietary source code, user interface designs, logos, trademarks (including “NavKids Africa”), and graphics associated with the Service are the exclusive intellectual property of NavKids Africa and are protected by Kenyan and international intellectual property laws. You may not copy, modify, distribute, or reuse any portion of our platform without explicit written authorization.

7. Termination and Suspension

We reserve the right to suspend or terminate access to the Service, without prior notice, for any account found to be in material breach of these Terms, engaged in fraudulent activities, or presenting a perceived safety risk to minors or platform infrastructure. Onboarding schools may terminate their service agreements subject to the specific terms outlined in their respective institutional Service Level Agreements (SLAs).

8. Governing Law and Jurisdiction

These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the Republic of Kenya. Any legal actions, disputes, or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.

9. Modifications to the Terms

NavKids Africa reserves the right to amend or update these Terms at any time to reflect software updates, regulatory shifts, or operational upgrades. We will notify users of any substantial changes by posting the revised Terms on our platform or sending a notification through the mobile application. Continued use of the platform after updates take effect constitutes your acceptance of the revised Terms.
